What Does the Supreme Court’s Overruling Mean?

In 1973, the sitting Supreme Court ruled that a woman’s right to an elective abortion was included in the U.S. Constitution, which granted it protection as a federal right.

 

However, this case was revisited in the summer of 2022 by the current Supreme Court, which found that the original ruling could not be substantiated. 

 

The reversal of this law removed federal protection for abortion. This means each state now has the authority to protect or regulate abortion access.

What Does the Supreme Court’s Overruling Mean for Women in Minnesota?

A woman’s state of residence will determine to what extent the overturning of Roe affects her access to abortion. 

 

Minnesota is one of the states that already had abortion included in its state constitution. The only way abortion would become illegal in Minnesota is if the state constitution was amended. 

 

Right now, abortion is legal in our state up to the point of viability. After this, abortion is legal if the woman’s life is endangered by the pregnancy.
